A man was walking his dog when a vehicle ran off the road and hit them. The collision killed them both

A fatal motor vehicle collision occurred Prosperity Church Road Charlotte, NC on July 1, 2020. Waltavius Mims, 31, was charged in the killing of Tran Viet Tran, 48, and his dog during a wreck on Wednesday night.

Shortly before 8:00 p.m. officers responded to reports of a motor vehicle collision.

Detectives with the Major Crash Investigation Unit, DWI Task Force, Animal Care and Control and Crime Scene Search responded to investigate. Officials say, Waltavius was driving a Toyota Highlander at a high rate of speed on Prosperity Church Road when he ran off the right side of the roadway and struck a mailbox. The vehicle continued and then struck Tran who was walking his dog on the sidewalk, causing fatal injuries to both.

The Toyota continued and traveled over a curb and into a wooded area where it struck a tree and came to a stop.

Impairment is not suspected as a factor in the crash, but test results are pending. Failure to maintain lane and reckless driving are suspected to be the proximate causes of the crash.  Waltavius was arrested and has been charged with misdemeanor death by vehicle and reckless driving. Waltavius was also cited for failure to maintain lane.
