On Saturday, August 8, 2020, at 3:40 p.m. Timothy Rice, 52, was killed after his motorcycle was hit in a multi car pile up on Sunset Road Charlotte, NC. 26-year-old James Brooks was arrested for his involvement in the crash.
The preliminary investigation revealed that a Chevrolet Avalanche was traveling on Sunset Road driven by James.
James struck the rear of a Nissan Altima. The Altima spun through the median and into the eastbound lanes where Timothy was operating a 2018 Suzuki motorcycle. The motorcycle struck the passenger side of the Altima while it was still in a spin and ejected Timothy from the motorcycle. All occupants of the Altima were transported to Novant Main with minor injuries. Timothy was transported to Atrium Health Main with life-threatening injuries where he was later pronounced deceased.
James was screened for impairment and was found not to be impaired. However, James was arrested and charged with misdemeanor death by vehicle, possession of marijuana, possession of drug paraphernalia, and failure to reduce speed.
The Chevrolet had heavy front-end damage. The Nissan had heavy rear and passenger side damage, it was also thrown off the roadside and in the grass. The front and side airbags were deployed in the Nissan.
While impairment is not a factor in this case, speed has been determined to be a factor.
