INVITATION FOR BIDS Project Identification: Oglala Lakota Arts & Business Incubator


This Document uses the term "Architect." Change this term to match that used to identify the design professional as defined in the General and Supplementary Conditions.

This Advertisement for Bids document is for use on public projects in conjunction with AIA Document A701, "Instructions to Bidders." Coordinate content with the Instructions to Bidders.

Much of this Document consists of Project-specific data. Examples given in the model document text below illustrate possible document content. Use the model text to develop text for specific Project requirements.


Revise "Notice to Bidders" Paragraph below to comply with Owner requirements for notification and conduct of public bidding.

A. Notice to Bidders: bidders may submit bids for project as described in this Document. Submit bids according to the Instructions to Bidders.

Retain "Regulatory Requirements" Subparagraph below and insert applicable references if bidding procedures are subject to special regulations, such as the Federal Acquisition Regulations.

Retain "Construction Manager" Paragraph below if Owner has engaged a construction manager.

Provide brief description of Project scope and budget to give potential bidders information to help them decide if they will consider bidding Project. If required, include subparagraph indicating estimated construction cost.

E. Project Description: Construction of a new building, of approximately 10,176 square feet, located on the Pine Ridge Indian Reservation in South Dakota, near the Pine Ridge Chamber of Commerce. The building will be used for arts and business with studio spaces, display areas and support spaces including administrative. Project also includes miscellaneous site work to accommodate the new building.

F. Construction Contract: Bids will be received for the following Work:

Revise sample subparagraphs below to correspond to the delivery system applicable to Project. Revise below if using construction management or design-build project delivery methods.

Revise first paragraph below to suit Project. Retain bid date and time consistent with local practices such as those recommended by regional AIA/AGC Joint Cooperative Committees.

A. Owner will receive sealed lump sum bids until the bid time and date at the location given below. Owner will consider bids prepared in compliance with the Instructions to Bidders issued by Owner, and delivered as follows:

  1. Bid Date: August 2, 2018.
  1. Bid Time: 2:00 pm MDT.
  1. Location: Lakota Funds, Lakota Trade Center, BIA 2, Kyle, SD, 57752.

B. Bids will be thereafter publicly opened and read aloud.


A. Bid security shall be submitted with each bid in the amount of 5 percent of the bid amount. No bids may be withdrawn for a period of 60 days after opening of bids. Owner reserves the right to reject any and all bids and to waive informalities and irregularities.


Retain "Printed Procurement and Contracting Documents" or "Online Procurement and Contracting Documents" Paragraph below and revise to suit Project.

A. Printed Procurement and Contracting Documents: Obtain after July 5, 2018, by contacting Copy Country, 1026 Main St., Rapid City, SD, 57701, 605-342-0425 telephone, 605-348-3010 facsimile. Complete sets of documents will be issued only.

  1. Deposit: One-hundred dollars ($100.00) made payable to Artspace. This Deposit is refundable upon return of undamaged documents within ten days of bid opening date.
  1. Shipping: Additional shipping charges of fifty dollars ($50) will apply. Shipping charge is non-refundable. Provide as a separate payment.

If retaining option in paragraph below, coordinate with the Contract Documents. Liquidated damages are typically listed in the Supplementary Conditions.

A. Successful bidder shall begin the Work on receipt of the Notice to Proceed and shall complete the Work within the Contract Time.


Retain and revise first paragraph below if prequalification of bidders is allowed and advisable for Project.

A. Bidders must be properly licensed under the laws governing their respective trades and be able to obtain insurance and bonds required for the Work. A Performance Bond, separate Labor and Material Payment Bond, and Insurance in a form acceptable to Owner will be required of the successful Bidder.

B. Provisions of the Oglala Sioux Tribal Employment Rights Ordinance (TERO) shall be strictly adhered to. All requirements shall be coordinated with the TERO Office at 605-867-5167.

C. All labor shall be in compliance with the OST TERO requirements and the Davis-Bacon Wage Determination Rates for Shannon County, South Dakota, included in the Bidding Documents. Where a discrepancy exists between Davis-Bacon and OST TERO, the stricter of the two will govern.

  1. A copy of the Davis-Bacon Wage Determination Rates for Shannon County, SD, is included as an attachment to this section for reference.

D. Liquidated Damages: Liquidated Damage in the amount of one-hundred dollars per calendar day are included in the Contract. See attached AIA A101 Owner-Contractor Agreement for additional information.
