WATCH: Phoenix Cops Kill Man after Responding to Noise Complaint over Video Game

Ryan Whitaker was sitting at home with his girlfriend playing video games when he was killed by police.

A noise complaint from an annoyed neighbor resulted in cops shooting and killing a man within five seconds of him opening his front door.

Ryan Whitaker opened the door holding a gun in his right hand which is legal in Arizona but it made the cops fear for their lives.

However, the cops never gave him a chance to put the gun down which he appeared to be trying to do when one cop shot him in the back three times.

"Why did you guys shoot him?" Whitaker's girlfriend, Brandee Nees, yelled as she stepped into the doorway.

"He just pulled a gun on us, ma'am," Phoenix police officer Jeff Cooke said.

"Because it's dark and someone just knocked on the door," Nees responded.

When Phoenix police officer John Ferragamo asked Nees if she and Whitaker had been fighting, she told him they were only playing video games.

"Literally we were making salsa and playing Crash Bandicoot so there may have been some screaming from PlayStation but it wasn’t domestic violence or anything," she said.

The incident took place on May 22 after an upstairs neighbor called police to complain about the noise.

"I gotta get to work tomorrow and I'm getting no sleep," said the neighbor in the second 911 call he made to police at 10:44 p.m.

When the dispatcher asked if the verbal argument has turned physical, he said it had turned physical but sounded as if he was just saying that to get police to respond quicker.

"It could be physical," he said. "I could say yeah if that makes anybody hurry on up. Get anybody here faster."

The cops arrived eight minutes later and knocked on the door with one of them yelling "Phoenix police" before both of them stepped off to the side, making it impossible for anybody to see them through the peephole. When Whitaker opened the door with the gun to his side, the cops shined their flashlights in his face, blinding him before noticing the gun.

"Whoa! Hands! Hands! Hands!" Ferragamo yelled as Whitaker lowered his body with his left hand in the air and his right hand appearing to be putting the gun down.

Cooke then fired three times, shooting him in the back.

Earlier that day, Whitaker had attended his daughter's high school graduation.

Whitaker's family has been demanding justice for his slaying, according to AZ Central:

"They shot my brother in cold blood and murdered him – murdered him," Steven said.

He challenged Phoenix Police Chief Jeri Williams to fire Cooke, who has been with Phoenix PD for about three years, and arrest him for murder.

"We want justice for Ryan," he said. "Be accountable for your actions. Hold people accountable."

"This proved everything I've been saying," Whitaker's sister, Katie Baeza, said. "In a fraction of a second, Jeff Cooke was a judge, jury and executioner of my brother."

"If you watch that video and are OK with it, you need to step down," she continued, directing her comment at Williams. She also said the man who called 911 escalated the situation unnecessarily and should be held accountable for that.

Bodycam footage was released last month but police say they are still "investigating" whether they will charge Cooke.

The video above includes the shooting from both cameras, including portions in slow motion as well as statements from Whitaker's girlfriend that they were not fighting. The 911 call that claimed they were fighting is also included. The caller has not been identified.

I'm going to to get a peep hole and a camera that can see what the peep hole can't.its a scary world out there today I don't want to end up like that guy. I didn't look like there was much time to assess the situation. Honestly I'd like to think that cop in that moment had enough time to react differently and that sucks now he is the bad guy

Quiet hours are after 11pm, he should be able to expect that, apartment or not.
To make up a false allegation though... neighbor should be prosecuted and officer that shot needs to reassigned to permanent desk duty. Not good that the officer had to affirm to the woman that they were not going to shoot her. Standing to the side is for officer safety, people do shoot through doors.

What a misleading headline. You've got to love the BIAS media these days. It was a domestic violence call. What it turned out to be later is not what these officers thought they were responding to. Look up Graham v Connor. It's what they thought at the time, not what is known now. Sad, but officers make decisions based on good faith that the caller and witnesses are telling the accurate truth.

Not saying that the cops should have killed the man, obviously that should NOT have happened; but, looking at the situation from the cops perspective, they were called in for a domestic dispute and all of a sudden a man comes out with a lethal weapon. Domestic dispute + lethal weapon = any number of things that could go wrong. For all the cops know, the weapon could have been involved in the "dispute". If anything, it's mostly the neighbor's fault for not going to them personally and finding out why they were being loud in the first place and taking appropriate action from there. At least then he would've known it was just them playing video games.

He clearly was backing away and putting the gun on the floor. The police were at the sides of the door and could not be seen through the peephole. They also came at night. I don't care if they said "it's the police" or whatever, anyone can claim to be the police when you cannot see them.

The 911 caller should be identified as well. He was the one who sent the minions to his home. He made a false report, therefore he is a criminal and he should face criminal charges.

You can tell they didn't give a fuck. They went in thinking it was a domestic disturbance an obviously let that fear influence how they were going to handle the situation. The guy who called them in the first place I hope didn't get any fucking sleep for he's as guilty as those cops that killed him. This may be a defense tactic but not when everything seems to be normal. When he walked out with his gun in his waist band he had it holstered before they even saw it an as he went to put it on the ground they opened fire on him claiming he was pulling it out to use against them. These officers need to be locked up or down right fired and released. Of all the police forces in this country Arizona needs serious police reform. They I'm sure lead the country in victim shootings

Its arizona its not uncommon to answer your door late at night with a weapon there is crazies out in arizona. Usually if someone knocks on your door late at night its not a good thing believe me. Guns are legal in arizona as long as you declare them. They had this all wrong from the getgo. First off police were quick to assess the threat level as high based on a incoming callers wrong impression that was purposely sent to harass the couple. They were playing video games probably too loudly for neighbors comfort level. Even loud enough they didnt hear "Police" knock and declare themselves. He looked like he was checking out who was at the door not meaning to cause any harm. The police should be held accountable by the last slow motion shot clearly see hes raising both arms as asked to do immediately. But the quick to open fire officer killed him and shot him down. This video makes me disgusted and i truly feel for his daughter and family. All this could have been avoided if they handled this properly and they took the time to investigate rather than act out ot fear and unneeded hostility.

Some things u mentioned I agree with...but what I dont agree with is that they had any right to kill this man. They never once gave order to put the gun down & he never raised it in a defensive gesture at all. That is where better training has to come in. Yes they are there to protect us but that doesnt mean they dont have to use common sense. They showed up at that apartment expecting a issue cause that caller was a dumbass. But with common sense u know that as a officer u gotta survey ur surroundings & never use leathal force unless threatened. That Man was only holding a gun & did not threaten those Officers. There is no way to have a winner in this scenario. If someone is at your door and yells "Arizona PD", why would you bring a gun out with you? You're putting yourself at risk. If you didn't hear the cop identify himself and didn't know it was PD, get your gun, stay in your house and call the Police. I'm not saying he should have been shot, just saying keep in mind when a cop goes to a door full of adrenaline, it's not a good time to test his ability to discern. Police officers need better training, there are too many of these incidents occurring where innocents are being killed. I can safely say I can't or could never be a cop, any sign of danger and I'm thinking I want to make sure I get home safe to my family by any means... I'd be trigger happy and would not make a good cop. Difference is, I know this and would never try to be a cop, I don't have the nerves for it. I feel for this mans girlfriend, what a tragic way to lose her significant other on what should have been a fun night of video games and excitement.

If I were his family I would include the neighbor in my lawsuit. This was straight up murder. The guy is clearly moving to put down his gun and the cop fired straight in to his back from less than 5 feet away.

He could easily disarmed him from the position that he had. Not to mention the horrible awareness of his line of fire. From that distance the rounds could have easily passed through the victim's body and gone through the wall in to the apartment next door. It's not a straight shot, but his partner was standing almost directly across from where he fired.

This video pisses me off as much as the one from one week later in Minnesota. I wonder why I didn't hear about this one on the news?

This so sad, this guy was clearly complying and not a threat. Soon as he saw the cop in front of him he put his hands in the air, got on his knees and put the gun down. I stopped the slow mo at 57 at 101 you can clearly see both arms stretched out out in front of him...before he was killed.... the shooter had to have seen this even at normal speed.... the weapon was on the floor, then arms stretched out, then the 3 dap kill shot also notice that his left arm is already out as he was placing the weapon down... look at the video again then comment.....
