WATCH: Phoenix Cops Kill Man after Responding to Noise Complaint over Video Game

Carlos Miller

Ryan Whitaker was sitting at home with his girlfriend playing video games when he was killed by police.

A noise complaint from an annoyed neighbor resulted in cops shooting and killing a man within five seconds of him opening his front door.

Ryan Whitaker opened the door holding a gun in his right hand which is legal in Arizona but it made the cops fear for their lives.

However, the cops never gave him a chance to put the gun down which he appeared to be trying to do when one cop shot him in the back three times.

"Why did you guys shoot him?" Whitaker's girlfriend, Brandee Nees, yelled as she stepped into the doorway.

"He just pulled a gun on us, ma'am," Phoenix police officer Jeff Cooke said.

"Because it's dark and someone just knocked on the door," Nees responded.

When Phoenix police officer John Ferragamo asked Nees if she and Whitaker had been fighting, she told him they were only playing video games.

"Literally we were making salsa and playing Crash Bandicoot so there may have been some screaming from PlayStation but it wasn’t domestic violence or anything," she said.

The incident took place on May 22 after an upstairs neighbor called police to complain about the noise.

"I gotta get to work tomorrow and I'm getting no sleep," said the neighbor in the second 911 call he made to police at 10:44 p.m.

When the dispatcher asked if the verbal argument has turned physical, he said it had turned physical but sounded as if he was just saying that to get police to respond quicker.

"It could be physical," he said. "I could say yeah if that makes anybody hurry on up. Get anybody here faster."

The cops arrived eight minutes later and knocked on the door with one of them yelling "Phoenix police" before both of them stepped off to the side, making it impossible for anybody to see them through the peephole. When Whitaker opened the door with the gun to his side, the cops shined their flashlights in his face, blinding him before noticing the gun.

"Whoa! Hands! Hands! Hands!" Ferragamo yelled as Whitaker lowered his body with his left hand in the air and his right hand appearing to be putting the gun down.

Cooke then fired three times, shooting him in the back.

Earlier that day, Whitaker had attended his daughter's high school graduation.

Whitaker's family has been demanding justice for his slaying, according to AZ Central:

"They shot my brother in cold blood and murdered him – murdered him," Steven said.

He challenged Phoenix Police Chief Jeri Williams to fire Cooke, who has been with Phoenix PD for about three years, and arrest him for murder.

"We want justice for Ryan," he said. "Be accountable for your actions. Hold people accountable."

"This proved everything I've been saying," Whitaker's sister, Katie Baeza, said. "In a fraction of a second, Jeff Cooke was a judge, jury and executioner of my brother."

"If you watch that video and are OK with it, you need to step down," she continued, directing her comment at Williams. She also said the man who called 911 escalated the situation unnecessarily and should be held accountable for that.

Bodycam footage was released last month but police say they are still "investigating" whether they will charge Cooke.

The video above includes the shooting from both cameras, including portions in slow motion as well as statements from Whitaker's girlfriend that they were not fighting. The 911 call that claimed they were fighting is also included. The caller has not been identified.

THIS WENT SIDEWAYS FOR A LOT OF REASONS ON BOTH SIDES. VICTIM SHOULD HAVE NEVER JUST OPENED THE DOOR, BUT RATHER ASK WHO IT IS AND HOLD BADGE IN FRONT OF WINDOW. THEN HE COULD SAY HE WAS OPENING THE DOOR AND THAT HE HAD A GUN. YOU NEVER APPROACH A COP WITH A HIDDEN GUN, EVER. COP SHOULD HAVE IDENTIFIED HIMSELF AND EVEN ASKED IT THE GUY HAD ANY GUNS. 2ND COP JUMPED THE GUN COULD HAVE DONE A FEW OTHER THINGS OTHER THAN SHOOT HIM 3 TIMES IN THE BACK WHEN IT WAS OBVIOUS THE GUN WAS POINTED IN A DOWNWARD POSITION. THAT BEING SAID THE COPS HAVE A RIGHT TO DEFEND THEMSELVES ESPECIALLY DURING THE LAST FEW MONTHS AND ALL THE COPS THAT HAVE BEEN KILLED. JUST NOT SURE THAT THIS OFFICER DID ALL HE COULD HAVE DONE TO AVOID WHAT I WOULD CALL A VERY QUESTIONABLE SHOOTING. SUCH A TRAGIC SHOOTING.

If that was my family member there would be ALOT of dead cops.
You live in fear from them killing you, its about time they, their families and friends feel the same way, dontcha think?

I'm starting to feel "unsafe" every time I see a cop anywhere in the neighborhood. Time to start shooting them on sight. For my safety.

This what you get then the statutory code enforcers training continuously tells them that people have no rights at all for any reason, at any time and that ending somebodies life is just a trivial thing.

I definitely have learned a lot from all the post . There are smart people and and some dumb as fuck. I'm going to to get a peep hole and a camera that can see what the peep hole can't.its a scary world out there today I don't want to end up like that guy. The sad thing is if you live buy the gun you just might die by it. I pack every day I walk out my door and it's not because of the police it's cuz fucked up people who don't care about taking a life for no reason. I'm not a cop and I'm going to wait around for them to save me or my loved ones and innocent civilians
Now from this tragedy I have different view don't awnser your door until you know who is on the other side. That man should of never open the door he would be here today .I'm sorry if this comment offends anyone but if i open my door like that lead is coming out at the time other wise it wouldn't be in my hand. Every legal gun owner should have solid gun training and a permit to prove it. That goes police officers also. There was 2 officers a team
My take the gun was pointed at the ground and he was blinded by tactical lawinforcement lights I think they could have got him with a tazer but I wasn't there
In my mind when I see a gun out something bad is going to happen and it did or a target will be lots of holes in it. Do I think the cop reacted to quick maybe. Do I think the man should of turned the noise level down and ask who was there before opening the door maybe
I didn't look like there was much time to assess the situation. Honestly I'd like to think that cop in that moment had enough time to react differently and that sucks now he is the bad guy
I don't think man was a bad guy
I've always tried to see things from different points of view
What if those were bad guys banging on the door and they were there to do a home invasion I don't think he would of had chance then either way he was not prepared to defend himself
And now I'm not a mind reader but man that cop only had a split second when he seen the gun
That's why I'm glad I'm not a cop cuz if I was that cop I'd be in his shoes right now I'm pretty sure that man did not intend to fire his gun the way he came to the door with it. That cop did his job he reacted fast for the position he was in
What was the cop suppose to turn and run when he seen.the gun? Fuck no that's not what I want our cop to do . It was a domestic call ok wow a guy opens the door with a gun just thinking about it is tripping me out. Sure there were some choices to make good ones and bad ones. #1is someone knocking on the door? I better turn down the game so I can hear better.fuck it's late who he'll could it be? Hey babe run go get my 9 who is it not sure I better chamber a round
Yeah who's there, Phoenix pd
Look out the peep hole
I don't see anyone
Ok those I believe were good choices
Now here we are bashing on cops and I remember not to long ago in Texas 2 officers were responding to a domestic call walked up to the door right in front of it and knocked the 2 officers were immediately gun down through the door and killed
Me just reflecting back a month or so
Now I wonder why cops stand off to the side when knocking I'm not sure if its hecause they don't know what surprise they might get aha maybe its just a little old lady wanting to give them a nice cold glass of lemonade oh how nice or maybe it's some shit stick who beat the shit out of his wife or girlfriend and threatening to blow her brains out and the dumb Ass awnsers the door with a gun in his hand maybe they should ask the guy polity to hang on a minute while the decide what to do right that sounds fair. Buzz wrong they are there to serve and protect that was an easy decision to make shit stick made a bad decision
But of course the media is going to make him out to be a victim. So for the end of my rant so now cops all over the country are being treated like bad guys because of a small percentage are bad. I'm no angel I've had my share of problems with the police and they were the choices that I made. I was 10 years old the first time I was arrested I'm 52 now and I can't remember how many times I've been arrested
2007 was the last time
I had no respect for the law
I've seen this country change a lot over the years and being a
A police officer I see is getting tougher all the time
Dealing with police today is a process it can be easy or hard the choices that you make will determine that
That man who was shot should of never open the door. Bad choice that cop that shot him was protecting him self and his partner end of story I'd of done the same. Fuck all you cop haters you'll need a cop some time and you should thank them for their sacrifice and help

They should kill Cooke’s wife/spouse in front of him and tell him to “relax”.

Simca1204

So basically there neighbor swatted them.
Quiet hours are after 11pm, he should be able to expect that, apartment or not.
To make up a false allegation though... neighbor should be prosecuted and officer that shot needs to reassigned to permanent desk duty. Not good that the officer had to affirm to the woman that they were not going to shoot her. Standing to the side is for officer safety, people do shoot through doors.

Jungletn
Jungletn

Cops standing to the side. instead of plainly visible.

Shine the light in the guys face so he cant see it is the cops.

Guy then realizes its the cops and begins to lower the weapon by squatting. Cops panic and shoot him.

THEN tell the freaked out GF to relax as she stares at the corpse of her BF. Don't react like normal people. Get them out and prosecute them. Then destroy the neighbors life.

IndyGrl
IndyGrl

What a misleading headline. You've got to love the BIAS media these days. It was a domestic violence call. What it turned out to be later is not what these officers thought they were responding to. Look up Graham v Connor. It's what they thought at the time, not what is known now. Sad, but officers make decisions based on good faith that the caller and witnesses are telling the accurate truth.

GCASTI666
GCASTI666

That snitch that called the cops needs to be shot.

Piccadilly
Piccadilly

Not saying that the cops should have killed the man, obviously that should NOT have happened; but, looking at the situation from the cops perspective, they were called in for a domestic dispute and all of a sudden a man comes out with a lethal weapon. Domestic dispute + lethal weapon = any number of things that could go wrong. For all the cops know, the weapon could have been involved in the "dispute". If anything, it's mostly the neighbor's fault for not going to them personally and finding out why they were being loud in the first place and taking appropriate action from there. At least then he would've known it was just them playing video games.

This associates the wrong culpability with the wrong people.

It is legal to own a gun in Arizona. Cops should not be trained to shoot people for owning a gun.

It is legal to startle cops in Arizona. Cops should very specifically be trained to not shoot people who startle or frighten them.

When a cop shows up at a scene of potential violence, they are not a survivor trying to make it out of a warzone alive. They are trained professionals who signed up to risk their lives to make others safer.

Anyone who shoots a civilian because in fear for their life has no business serving in a line of duty where fear for one's life is part of the job description.

That is all.

From an officers perspective, if you can't handle the job and your first instinct is to shoot someone multiple times instead of the arm or legs, then you need to turn in your badge. As the other commenter stated, your job is to remain under control. These trigger happy cops have to go!
If you fear for your life this easily, go be a security guard or cross walk officer, don't carry a gun.

CannedNoodlez
CannedNoodlez

I created an account just to reply to the ridiculous "arms and legs" comment. It is clear you have never fired a gun. This officer was trigger happy, but saying he should have shot the legs or arms is one hundred percent being naive at how the real world is.

Or the nosy neighbor would have been shot by the dude that was killed by the cops! You can “what if” all you want but the cops should have warned the guy to drop the weapon! The whole world is on edge and in chaos

This is why I just don't answer the door for anyone unless I'm expecting visitors. Period. You don't have to answer the door for the police. You don't have to talk to the police. You don't have to talk to anyone if you don't want to. They will get bored after a couple minutes of silence and fuck off, or they'll kick the door in if they really need to get at you.

Well fuck, I guess video games really DO cause violence.

TheSimpleton

He clearly was backing away and putting the gun on the floor. The police were at the sides of the door and could not be seen through the peephole. They also came at night. I don't care if they said "it's the police" or whatever, anyone can claim to be the police when you cannot see them.

"He pulled a gun on us", yeah he did because he had no idea who the hell you idiots were and it was in the middle of the night. This is straight up murder, plain and simple. A man literally gets killed for making salsa and playing Crash Bandicoot.

The 911 caller should be identified as well. He was the one who sent the minions to his home. He made a false report, therefore he is a criminal and he should face criminal charges.

Samm505
Samm505

You can tell they didn't give a fuck. They went in thinking it was a domestic disturbance an obviously let that fear influence how they were going to handle the situation. The guy who called them in the first place I hope didn't get any fucking sleep for he's as guilty as those cops that killed him. False accusations and he lied so they'd hurry up and get to the scene of their crime faster. Obviously under 5 secs tells me they already new they'd be plugging bullets into someone before they got there. And yes they cowardly hid in the shadows. This may be a defense tactic but not when everything seems to be normal. When he walked out with his gun in his waist band he had it holstered before they even saw it an as he went to put it on the ground they opened fire on him claiming he was pulling it out to use against them. These officers need to be locked up or down right fired and released. Of all the police forces in this country Arizona needs serious police reform. They I'm sure lead the country in victim shootings

Its arizona its not uncommon to answer your door late at night with a weapon there is crazies out in arizona. Usually if someone knocks on your door late at night its not a good thing believe me. Guns are legal in arizona as long as you declare them. They had this all wrong from the getgo. First off police were quick to assess the threat level as high based on a incoming callers wrong impression that was purposely sent to harass the couple. They were playing video games probably too loudly for neighbors comfort level. Even loud enough they didnt hear "Police" knock and declare themselves. He looked like he was checking out who was at the door not meaning to cause any harm. The police should be held accountable by the last slow motion shot clearly see hes raising both arms as asked to do immediately. But the quick to open fire officer killed him and shot him down. This video makes me disgusted and i truly feel for his daughter and family. All this could have been avoided if they handled this properly and they took the time to investigate rather than act out ot fear and unneeded hostility.

lawabindingcitizen

well first of all you shouldn't answer the door with a gun in your hand... that's just dumb...

CanThisBeReal

There is no way to have a winner in this scenario. If someone is at your door and yells "Arizona PD", why would you bring a gun out with you? You're putting yourself at risk. If you didn't hear the cop identify himself and didn't know it was PD, get your gun, stay in your house and call the Police. I'm not saying he should have been shot, just saying keep in mind when a cop goes to a door full of adrenaline, it's not a good time to test his ability to discern. Police officers need better training, there are too many of these incidents occurring where innocents are being killed. I can safely say I can't or could never be a cop, any sign of danger and I'm thinking I want to make sure I get home safe to my family by any means... I'd be trigger happy and would not make a good cop. Difference is, I know this and would never try to be a cop, I don't have the nerves for it. I feel for this mans girlfriend, what a tragic way to lose her significant other on what should have been a fun night of video games and excitement.

If I were his family I would include the neighbor in my lawsuit. This was straight up murder. The guy is clearly moving to put down his gun and the cop fired straight in to his back from less than 5 feet away.

He could easily disarmed him from the position that he had. Not to mention the horrible awareness of his line of fire. From that distance the rounds could have easily passed through the victim's body and gone through the wall in to the apartment next door. It's not a straight shot, but his partner was standing almost directly across from where he fired.

This video pisses me off as much as the one from one week later in Minnesota. I wonder why I didn't hear about this one on the news?
