WATCH: Man Shoots 2 Cops as they are Pulling him from Car, Pepper Spraying him

An Oklahoma man, David Ware, is accused of murdering one Tulsa cop and wounding the other during a traffic stop.

A routine traffic stop for an expired tag led to a man shooting two cops before fleeing, killing one and injuring the other.

David Anthony Ware, 33, is now facing the death penalty for charges on first-degree murder and attempted murder.

However, Ware's sister is claiming Ware acted in self-defense because he was in fear for his life as the cops were trying to pull him from his car.

Dash and body cam footage released this week show one cop pepper spraying Ware repeatedly for not stepping out of the car while the other cop tasers him.

At one point as they are pulling him from his car, Ware reaches under his seat and pulls out a gun, shooting both Tulsa police officers, killing Sergeant Craig Johnson and critically injuring Aurash Zarkeshan. Johnson was the cop pepper spraying him.

An Oklahoma judge ordered the video released despite objections from Tulsa Police Chief Wendell Franklin by insisting the public should not be allowed to "see the execution of a police officer."

But now Ware's attorney is accusing the chief of having misreported the facts about the shooting to paint his client as a "cold, calculated killer" by claiming Ware stood over a wounded cop and fired three more shots into him when the video does not show that.

According to The Frontier:

In the affidavit, Tulsa Police said Ware stood over an already wounded Johnson and fired three shots at him. Police chief Wendell Franklin, who was appointed to the position in January and became the city’s first Black police chief, held a press conference after the shooting and gave a similar description of Ware’s actions.

But Ware’s attorney, Kevin Adams, called the description inaccurate and said it was part of an attempt by the police department and district attorney’s office to paint Ware as a “cold, calculated killer.” Adams said he believed District Attorney Steve Kunzweiler intended to seek the death penalty against Ware and that if that were to happen, Oklahomans deserved to see for themselves how accurate the initial description of the encounter between police and Ware was.

Franklin opened Monday’s media conference by saying that criminals “have more rights” than citizens or police officers, and that the public “would never” see a criminal being executed, “but here we are watching the execution of a police officer. What kind of society is that?”

He said the discrepancies between the initial police report and what the video showed were not intentional deceptiveness, but instead a matter of officers quickly relaying what happened at the scene, a sort of game of telephone where the truth gets slightly distorted as it passes from officers to the public.

“We are as accurate as we can be, but realistically the discrepancies don’t matter,” Franklin said.

Tulsa police released a video that is longer than 15 minutes, showing officer Aurash Zarkeshan pulling Ware over after Ware pulled out in front of him from a side street.

Zarkeshan discovers Ware's tag is expired and he does not have a drivers license although Ware identifies himself and provides his date-of-birth. The situation escalates when Zarkeshan orders Ware out of the car and he refuses.

For more than ten minutes, both cops repeatedly order him out of the car but he refuses. At one point, he calls his friend, Matthew Hall, to come pick him up. Ware hops in Hall's car which drives away, leaving both cops on the ground with bullet wounds.

Ware was arrested the following day and has been incarcerated since. Hall has also been arrested as an accomplice to murder and has also been incarcerated since the shooting. In June, he attempted suicide in jail but failed.

Earlier this week, a third man, Jakob Garland, was arrested in connection with the incident for giving Ware the gun that he used. Ware was a felon and not legally allowed to possess a gun.

In July, when the judge was refusing to release the video, Ware's sister, Ashley Melendy, said she believed her brother was acting in self-defense, according to KTUL.

Yes Blue Lives Matter, as long as they themselves aren't conducting themselves in a criminal manner. Same as is with All lives! Thinking just because you wear a gun and badge suddenly makes you magically better than anyone else is nonsense. If anything you should be held to higher standards because you've been entrusted with keeping people safe. That includes from bad cops. You can't just basically torture someone with pepper spray and tasers because they don't comply with a civil matter (yes all non victim traffic violations are a civil matter, not a criminal matter). Just write the ticket and be on your way. Let the courts do the job of determining guilt. Plain and simple!

Seems most of you people believe cops have the right to protect themselves, even when NOT threatened by shooting suspects. Yet, after all the unwarranted police shootings we have seen of non-violent, unarmed, sometimes surrendering people, we are supposed to just give up and allow ourselves to be harmed. Yes, he broke a rule. Not a major one, but obviously enough for the cops to get crazy because they hate to be ignored and disrespected. Now we have a dead cop and a soon to be imprisoned man for a minor offense. This is not Justice, on either side. But, I happen to agree that it was self-defense. Not murder.

Anyone who think that Ware was in the right IS AN IDIOT!! He was given EVERY chance to come out of the situation with no harm to himself or others. Had he cooperated with the cop's request to step out of the car, yes, he would have been arrested and taken to jail. His car would have been towed, and at some point it would have been searched, and the gun would have been found. At that point, he WOULD be doing more time, since as a felon he was not allowed to have a gun. THAT was what he was afraid of. And it did Ware absolutely NO good to shoot the cops and escape, because they found him and arrested him soon after. Now he's looking at the DEATH penalty for murder. Ware screwed himself over big time.

The stop started as usual, the driver stopped, was trying to find DL, but when did not, gave all his information, after which the cops had a little discussion and decided that it's a good idea to assault him. "Because you have a history of narcotics" - not a valid reasonable suspicion. If I was on the jury at the trial, I would vote to acquit.

This looks like self defense to me, and it all started over an alleged infraction, not a misdemeanor or felony stop. The cops using forced and violent brutality against the traveler were opening themselves up to a violent response from the victim of their attacks. Were these cops stupid, or poorly trained? Their attitude seemed to deserve the reward they received.

Look, the cops in America have almost universal immunity for the force and violence they use on others, and that is something the ordinary citizen does not have. Why is that?

Let's change the scenario a bit. Let's pretend it was a cop traveling by car and two civilians stopped him and used the same force and violence on the cop. I suspect the cop, under these circumstances, would get an immediate pass for his shooting the two attackers. But the civilian does not. Prove me wrong.

So, why do cops get a pass for their crimes? Who the hell decided to give cops a pass for the violence they use on the public? Their occupation is not even in the top ten of most dangerous jobs and you can't blame their actions on defensive mentality, so again, why do they invariably get a pass? Why the hell are cops NOT held responsible for their violent and often deadly actions against others?

Everyone knows driving illegally will get you stopped, towed, whatever. Who pulls out in front of a police car? And Ware knew he had a gun in his car 6x pulled over for tag violations aside from previous narcotics charge. Plain & simple if you deal drugs you usually have a gun albeit illegally. Officers gave him way more chances than black folk get. He was scared of going to prison for 5 years on gun charge. Now he will do life and 4 families have suffered bc he is not a man that can own his consequences of stupidity. Despite police being over arching rights violators, these officers gave him way more chances than most. This type of encounter is what makes the police this way. The job makes you jaded after these incidents. Their intuition was correct. Sadly a life was lost and that is due to Ware’s actions or inaction or reaction.
I think all men or boys and women too should have to serve in the military where you are forced to learn respect. Then this young society who thinks its ok to do/sell/transport drugs and you have rights to do them (you don’t while driving your car on any street not private), would not be such a problem and the circumstances surrounding such incidents.

There are a lot of videos where cops mame and murder innocent people and pets for no reason and I advocate for the victims there, however, this looks like bad acting by a Thug, I saw that police gave the suspect in this case Every oppertunity to do the right thing and he ignored everything that was asked of him. I do believe that in this case cops were 100% right in the way this was handled, and this thug actually killed a good cop and injured the other!!!

Wade escalated this encounter after he refused to comply with a lawful order, not 10, not 20, not 30, but over 40 times! If you think that's is being overly aggressive or overstepping their authority, you need to seek help. Think about this situation if you're pulled over and consider the consequences if you think it's okay to murder a cop! If you're a felon in possess a firearm, you're going to get killed if the officers even have the hint that you're going to use it! You completely gave yourself away when you make idiotic statements and announce you're going to condon killing someone. The order to get out of the vehicle because "you have a history of narcotics" was not lawful. Case law allows the cops to order vehicle occupants out for officer safety. This was not the case. Accordingly, what followed was completely illegal assault of two violent criminals on a citizen, and his self-defense was both legally and morally justified.

The officer should of never touched this young mans door. The two officers should have gave him a ticket and if the judge was going to seize the vehicle that would have been left to the judge to decide. This man felt violated. This is a sad result of excessive force. People are fed up!

Didn't have an ID and also didn't have insurance. That's enough to tow your car. I don't want anyone driving around without insurance. A man ran my sister over when she was on her bike and took off because he didn't have insurance. Maybe you want your mom or your dad or your girlfriend or wife or your child to be in the same situation and get ran over and pray your health insurance will pay for the life threatening surgery and treatment. ALL else aside this guy was obviously terrified for his life. It didn't matter that he had a minor traffic violation. What mattered was he was terrified whether justified or not he OBVIOUSLY needed mental help at that moment. I don't understand why cops are allowed to mentally harm ppl who pose no immediate threat to anyone. They easily could have called higher up as requested by Mr. Wares but no they are far too egotistical And angry for that. Its about THEM when it's supposed to be about the citizens. This isn't ok.
